Online - FOI: Contracts and Commercial Confidentiality
When public authorities enter into contracts, outsource services, or buy goods and services they enter into a relationship that involves the exchange of commercial information. Businesses often regard this as “confidential” and sometimes believe that stamping it as “secret” means that its confidentiality is protected. However as public authorities are subject to both the Freedom of Information Act and the Environmental Information Regulations, this confidentiality cannot be guaranteed.

This course will examine the provisions of Sections 43 and 41 of the FOI and EIR exceptions 12 (5) (e) and (f) in order to provide a detailed, up to date examination of the way in which these exemptions/exceptions operate. The aim is to provide delegates with the knowledge and understanding to help them determine when information may be lawfully withheld after an access for information request.

It will also examine the wider transparency agenda when it comes to public authority spending and outsourcing and examine proactive approaches to ensuring greater clarity about what information may be released into the public domain. The course is aimed at those experienced practitioners who have a sound knowledge and understanding of the operation of the FOI and who wish to focus on how the FOI applies to commercial information.

The course will include an examination of some key legal decisions and recent developments in the law.
